Jury trial against Google in Arizona, other states also file lawsuits for privacy violations

Arizona’s Attorney General Mark Brnovich ‘s office launched a probe into Google’s practices in 2018 after an Associated Press investigation “found that many Google services on Android devices and iPhones store your location data even if you’ve used a privacy setting that says it will prevent Google from doing so.”

In 2020, after a 2 years investigation the State of Arizona filed a consumer fraud lawsuit against Silicon Valley tech behemoth Google Inc. for its “deceptive” and “unfair” methods of obtaining user location data. The lawsuit was pushed forward after an Arizona Judge gave it the okay. 

Details: The lawsuit is seeking unspecified damages for Alphabet Inc ‘s Google’s deception of users of its Android mobile operating system. This includes their physical location which is used for advertising purposes.

Google sought summary judgment to get the case thrown out in an early stage. Google argued that the state failed to show that its consumer fraud law could apply and noted that Google had clarified its disclosures about privacy settings.

However, an Arizona Judge Timothy Thomason has now ruled that the case will not be tossed out but should be heard by a jury.

In his ruling, Judge Thomason acknowledged that the state’s “contention that Google’s alleged deception is in connection with the sale or advertising of merchandise is, at times, somewhat strained,” and partially granted Google’s request for summary judgment “as to the state’s theory that the sale of ad placements to their parties is connected to a consumer sale.” The judge denied Google’s motion to toss the case in all other respects.

Following Arizona , attorneys general in Washington, D.C., and the states of Washington, Indiana and Texas have all sued Google on similar grounds, Reuters reported.
